SECOND SUPPLEMENTARY AGREEMENT (1) to the Agreement of 21 March 1955 on the establishment of through international railway tariffs

THE REPRESENTATIVES OF THE GOVERNMENTS OF THE MEMBER STATES OF THE EUROPEAN COAL AND STEEL COMMUNITY, MEETING IN COUNCIL,

Having regard to Article 70 of the Treaty of 18 April 1951 establishing the European Coal and Steel Community;

Pursuant to the provisions of the second paragraph, and of subparagraph (2) of the third paragraph, of Article 10 of the Convention on the Transitional Provisions, concerning the establishment of through international tariffs;

Having regard to the Agreement of 21 March 1955 on the establishment of through international railway tariffs;

Having regard to the Supplementary Agreement of 16 March 1956 to the Agreement on the establishment of through international railway tariffs;

HAVE AGREED AS FOLLOWS:

Article 1

The following item B shall be substituted for item B of Annex I to the Agreement of 21 March 1955:

"B - Carriage of coke to and from Italy:

Notwithstanding the provisions of Article 10 of this Agreement, charges for the carriage of coke consigned from a Member State to Italy and vice versa shall be determined as follows: (1) For the purpose of calculating the Italian sectional charge, the Italian coefficient of degressivity corresponding to the length of the sectional distance in Italy shall be applied;

(2) For the purpose of calculating the sectional charge for each of the other Member States, the national coefficient of degressivity corresponding to the total distance less the length of the sectional distance in Italy shall be applied."

Article 2

The date 31 August 1959 shall be substituted for 30 April 1959 in Article 1 of the Supplementary Agreement of 16 March 1956 referred to above.

Article 3

The text of this Agreement, as recorded in the minutes of the proceedings of the Council, shall be published in the Official Journal of the European Communities.

This Agreement shall enter into force on 1 May 1959. (1) This Second Supplementary Agreement was concluded during the 59th Session of the Council, held on 23 March 1959.
